These terms can not be adjusted or altered in any way unless expressly agreed upon by the owner in writing and signed for. By accessing this website you agree to all terms of usage inclusive, but not exhaustive, of as follows:

  • All content on this site is copyright protected and any unauthorized usage of this content will lead to legal action being taken. If you would like to license for personal or commercial purposes any images you see here please contact the site owner through the form on the contact page.

  • No sharing is allowed of content that is locked behind members only areas and/or password protected areas, without express written consent from the owner.

  • All comments posted are monitored and thus held to the decency and copyright infringement laws and requirements and will be handled accordingly by law and at the discretion of the site owner.

Photography Terms of Service

In the following terms and conditions the usage of the term “the photographer/photographer” means Joseph Hines DBA Joey Hines Photography. “The Client/Clients” is in place of people who have agreed to, and purchased services from, the photographer. These terms can not be adjusted or altered in any way unless expressly agreed upon by both parties in writing and signed for. By agreeing to photographic services of the photographer you agree to all terms inclusive, but not exhaustive, of:

  • Clients are to be aware that the copyright of all images taken are retained by the photographer unless agreed upon through contract and payment. This means that all photos taken by photographer can be used as part of the photographers portfolio, or other promotional means such as, but not limited to, social media, fliers, sample portfolios, etc.

  • Clients are to be aware that all photo shoots are at the artistic discretion of the photographer. The photographer will take into consideration client requests, but client is made aware that all expectations should be derivative of previous work displayed in photographers portfolio. Client is made aware that if specific requests are not carried out that is not deemed an acceptable reason for refund of commission paid.

  • There will be a mandatory deposit of 25% upon agreeing to a photo shoot and location. This deposit is nonrefundable except in situations that fall under an “act of God.” Such as, but not limited to, car accident, severe illness, victim of crime, etc. Client should reach out as soon as possible in the event of an “act of God” situation. The photographer is bound by the same “act of God” agreement. In the unlikely event that the photographer is unable to make agreed upon time/location of photo shoot a reschedule opportunity, or refund of deposit, will be made. In the event of inclement weather customer has the opportunity to reschedule the photo shoot.

  • Client assumes all risks involved in photo shoot. Any direction given by photographer, and performed by client, during photo shoot is a form of consent and understanding of presumed physical and mental ability to perform said request. The photographer can not be held liable for any accidents or injuries incurred during photo shoot.

  • Remaining payment will be due on the day of the photo shoot before any photos have been taken.

  • Outside of extreme instances, such as complete and utter negligence, satisfaction with photos is not a valid reason for refund of commission paid to photographer.

  • The photographer will take all steps to deliver the digital files as quick as possible. With this being said it could take up to 4 weeks to receive the digital files.
